Urteil: Kündigung von Justiziarin bei Erzbistum Köln unwirksam
Die fristlose Kündigung der Justiziarin des Erzbistums Köln wegen eines mitgenommenen Bürostuhls ist nach Auffassung des Arbeitsgerichts der Stadt unwirksam. Die Mitnahme von Eigentum des Arbeitgebers nach Hause stellt zwar eine Pflichtverletzung dar, reicht in diesem Fall aber nicht als Begründung für eine außerordentliche Kündigung aus, wie das Gericht am Dienstag erklärte. Das Erzbistum habe der Arbeit von zu Hause generell Vorrang eingeräumt, ohne die dafür notwendige Ausstattung zur Verfügung zu stellen.
Auch die Versetzung der Frau in den Ruhestand bewertete das Arbeitsgericht nun als unwirksam. Dafür hätte es eine Prognose über eine Dienstunfähigkeit für das darauffolgende halbe Jahr gebraucht. Eine mehrere Monate alte vertrauensärztliche Stellungnahme habe diese Prognose nicht gerechtfertigt, hieß es.
Ein Schmerzensgeld stand der Frau nach Auffassung der Kammer jedoch nicht zu. Die ehemalige Mitarbeiterin hatte mindestens 50.000 Euro wegen "unzureichender Schulung und Supervision" im Zusammenhang mit der Aufarbeitung von Missbrauchsfällen im Erzbistum gefordert. Das Erzbistum sei seiner Fürsorgepflicht als Arbeitgeber nicht nachgekommen, argumentierte sie.
Die Aufarbeitung sei notwendig gewesen, begründete das Gericht nun seine Entscheidung. Die damit verbunden Belastungen für die Mitarbeiter des Erzbistums waren nach Auffassung der Kammer "unvermeidbar". Der Justiziarin sei zuzumuten gewesen, selbst beim Erzbistum um notwendige Unterstützung zu bitten.
Die Frau arbeitete seit 2008 beim Erzbistum Köln. Im Juli vergangenen Jahres wurde der Leiterin der Stabsabteilung Recht wegen des Bürostuhls gekündigt. Zudem wurde sie mit der Begründung, dauerhaft dienstunfähig zu sein, in den Ruhestand versetzt. Dagegen ging sie gerichtlich vor. Gegen das Urteil kann Berufung beim Landesarbeitsgericht in Köln eingelegt werden.
