Bundesgerichtshof verhandelt über Entfernung einer negativen Bewertung bei Ebay
Der Bundesgerichtshof (BGH) verhandelt am Mittwoch (11.00 Uhr) in Karlsruhe über eine negative Bewertung bei Ebay. Bei einem Geschäft wurden über Ebay vier Gelenkbolzenschellen zur Befestigung von Schläuchen für etwa 14 Euro plus knapp fünf Euro Versandkosten gekauft. Der Käufer bewertete das Geschäft später auf der Plattform und schrieb, die Ware sei zwar gut, die Versandkosten seien aber "Wucher!!". (Az. VIII ZR 319/20)
Der Verkäufer zog vor Gericht, um zu erreichen, dass dieser Teil der Bewertung entfernt wird. Den Allgemeinen Geschäftsbedingungen von Ebay zufolge müssen Bewertungen "sachlich" gehalten sein und dürfen keine "Schmähkritik" enthalten. Das Landgericht Weiden verurteilte den Käufer dazu, die Bewertung zu entfernen. Sie sei überspitzt und habe keinen sachlichen Bezug. Gegen dieses Urteil zog der Käufer vor den BGH.
