Eine Solaranlage auf einem Hausdach darf die Nachbarn nicht unzumutbar blenden. Derartige Hinderungen an einer beschwerdefreien Nutzung des Hauses müssen nicht hingenommen werden, teilte das Landgericht im rheinland-pfälzischen Frankenthal am Donnerstag mit. Es verurteilte ein Ehepaar dazu, seine Fotovoltaikanlage so auszurichten, dass sie die Nachbarn nicht mehr wesentlich blenden kann. (Az. 9 O 67/21)
Die klagenden Nachbarn hatten sich über Blendungen unter anderem im Garten, auf der Terrasse und im Wohnzimmer beschwert. Ein Gutachten gab ihnen Recht. Dieser Einschätzung folgten auch die Richter. Demnach kommt es in den Sommermonaten zwischen 17.00 und 18.00 Uhr zu einer direkten Sonnenlichtreflexion zum benachbarten Haus. Die Spiegelung sei fast so hell wie der Blick in die Sonne selbst. Eine Blendung führe zu zeitweisen Einschränkungen der Sehfähigkeit.
Den Nachbarn ist es laut Gericht nicht zuzumuten, die Terrasse in diesem Zeitraum nicht nutzen zu können und die Innenräume durch Rollläden verdunkeln zu müssen. Die Richter wiesen zudem darauf hin, dass es für Solaranlagen auch Spezialmodule gebe, deren Oberflächen das Licht weniger stark reflektierten.
