OLG Celle gibt Porsche und VW in Milliardenstreit um gescheiterte Übernahme recht
Das Oberlandesgericht (OLG) Celle hat die Milliardenforderungen von Anlegern im Musterverfahren gegen Porsche und Volkswagen nach der gescheiterten Übernahme zurückgewiesen. Der Sportwagenbauer habe nicht verwerflich gehandelt, als er den Kapitalmarkt 2008 über die beabsichtigte Übernahme informierte, erklärte das Gericht am Freitag. Die Kläger warfen den Autobauern vor, sie bewusst in die Irre geführt zu haben.
Der Kurs der VW-Aktie schwankte damals nach verschiedenen Erklärungen Porsches stark, wodurch viele Investoren Geld verloren - bei manchen geht es um Milliarden. Vor dem OLG Celle machten 42 Kläger Ansprüche von insgesamt 5,4 Milliarden Euro geltend. Unter ihnen waren sowohl private Anleger als auch Hedgefonds.
Das Musterverfahren dauerte fünf Jahre. Darin sollten Fragen beispielhaft geklärt werden, sodass sich andere Gerichte daran orientieren können. Das OLG teilte nun weiter mit, dass Volkswagen nicht hafte, weil sein Vorstand von den Übernahmeplänen nichts wusste und Aufsichtsratsmitglieder, die auch bei Porsche tätig waren, zur Verschwiegenheit verpflichtet gewesen seien.
Rechtskräftig ist die Entscheidung noch nicht: Die Kläger können sich noch an den Bundesgerichtshof in Karlsruhe wenden.
Porsche begrüßte die Entscheidung. Der Autobauer teilte mit, er sehe sich in seiner Rechtsauffassung bestätigt. Nachdem die geplante Übernahme scheiterte, gehört Porsche inzwischen zu VW.
