Amt darf Ärztin in Rheinland-Pfalz Verschreibung von Drogensubstitution verbieten
Das rheinland-pfälzische Landesamt für Soziales, Jugend und Versorgung hat einer Ärztin das Verschreiben von Drogensubstitutionen verbieten dürfen. Die Frau habe erheblich gegen rechtliche Vorschriften verstoßen, teilte das Verwaltungsgericht Koblenz am Mittwoch mit. Dadurch bestehe eine Gefahr für die Sicherheit des Betäubungsmittelverkehrs. Die Ärztin hatte über sechs Jahre in mindestens 138 Fällen Patienten Drogen für die eigenverantwortliche Einnahme zu Hause verschrieben. Das Amt warf ihr vor, sogenannte Take-Home-Verschreibungen vorgenommen zu haben, ohne dass die dafür notwendigen gesetzlichen Voraussetzungen vorgelegen hätten.
Laut Gesetz müssen Ärzte unter anderem darauf achten, ob Risiken einer Selbst- oder Fremdgefährdung weitestmöglich auszuschließen sind. Das gilt insbesondere, wenn Kinder mit im Haushalt leben. In einer Vielzahl von Fällen seien diese Voraussetzungen nicht erfüllt gewesen.
Dieser Argumentation folgten die Koblenzer Richter. Die Ärztin habe gewusst, dass bei einer Feier einer Patientin ein Bekannter ihres Sohns infolge einer Überdosis an einem von ihr verschriebenen Drogenersatzstoff gestorben sei. Die Patientin muss sich seit Juni in einem Berufungsprozess wegen fahrlässiger Tötung vor dem Landgericht Bad Kreuznach verantworten.
Bei anderen Patienten habe es Hinweise gegeben, dass die Patienten neben den Ersatzstoffen weitere Drogen konsumierten. Trotzdem habe die Ärztin weiter Substitutionsmittel verschrieben. Die Verfehlungen seien qualitativ und quantitativ von "besonderem Gewicht". Zudem habe die Ärztin keine Einsicht gezeigt.
