Karlsruhe: Sonderprüfung bei Volkswagen muss neu verhandelt werden
Volkswagen hat im Streit um die Aufklärung des Dieselskandals einen Erfolg vor dem Bundesverfassungsgericht eingefahren. Karlsruhe erklärte am Freitag, dass das Oberlandesgericht Celle bei der Einsetzung eines Sonderprüfers 2017 das Recht des Autobauers auf rechtliches Gehör verletzt habe. Aktionäre waren damals in Celle vor Gericht gezogen, sie forderten eine externe Kontrolle, um eine mögliche Verantwortung von Vorstand und Aufsichtsrat zu prüfen. (Az. 1 BvR 2754/17 u.a.)
Das Bundesverfassungsgericht entschied nun, dass das Oberlandesgericht neu über den Fall verhandeln muss, ebenso wie über die Ersetzung des Sonderprüfers durch einen anderen im Jahr 2020. Auch dabei habe es Rechte von VW verletzt. Die entsprechenden Entscheidungen wurden nun aufgehoben. Ende 2017 hatte Karlsruhe allerdings einen Eilantrag von VW abgelehnt, so dass der Wirtschaftsprüfer bereits mit seiner Arbeit beginnen konnte.
2015 war bekannt geworden, dass Volkswagen in Dieselmotoren eine Manipulationssoftware einbaute, weswegen die Abgas-Grenzwerte nur auf dem Prüfstand eingehalten wurden. Der Aktienkurs ging zwischenzeitlich steil nach unten, außerdem sieht sich der Konzern seitdem zahlreichen Gerichtsverfahren ausgesetzt. Viele Autokäufer fordern Schadenersatz.
Am Freitag teilte der Gesamtverband der Deutschen Versicherungswirtschaft mit, dass die Prozesskosten für Rechtsstreits rund um Dieselmanipulationen - nicht nur von VW, sondern insgesamt - seit 2015 auf rund anderthalb Milliarden Euro gestiegen seien. Im Streit mit Autoherstellern hätten bis Ende Oktober dieses Jahres 413.000 Kunden ihre Rechtsschutzversicherung in Anspruch genommen.
