Bundesgerichtshof urteilt über Entschädigung für Musiker wegen Corona-Maßnahmen
Der Bundesgerichtshof (BGH) verkündet am Donnerstag (10.00 Uhr) in Karlsruhe seine Entscheidung über mögliche Entschädigungsansprüche eines Musikers für Einnahmeausfälle in der Pandemie. Der Berufsmusiker hatte gegen das Land Baden-Württemberg geklagt, weil ihm wegen der Coronaschutzmaßnahmen im Frühling und Sommer 2020 Einnahmen entgangen seien. Seine Aufträge bestünden zu mehr als 90 Prozent aus Live-Auftritten, gab er an. (Az. III ZR 54/22)
Baden-Württemberg hatte wie die anderen Bundesländer zu Beginn der Pandemie Veranstaltungen zunächst verboten und das Verbot später stufenweise gelockert. Das Stuttgarter Landgericht hatte die Klage des Musikers abgewiesen, auch in der Berufung vor dem Oberlandesgericht hatte er keinen Erfolg. Nun soll der BGH urteilen. Dieser hat bislang staatliche Haftung für Einnahmeausfälle wegen der Schutzmaßnahmen ausgeschlossen. Dabei ging es um Friseursalons und Gaststätten.
