Bundesgerichtshof verhandelt über Bewerben von Süßigkeiten als "klimaneutral"
Eine Klage der Zentrale zur Bekämpfung unlauteren Wettbewerbs gegen den Süßwarenhersteller Katjes beschäftigt am Donnerstag ab 10.00 Uhr den Bundesgerichtshof (BGH) in Karlsruhe. Verhandelt wird, ob Katjes Fruchtgummis als "klimaneutral" bewerben durfte, obwohl sie nicht emissionsfrei produziert werden. Katjes kompensiert das durch die Unterstützung von Klimaschutzprojekten. (Az. I ZR 98/23)
Wegen dieses Vorgehens hält die Wettbewerbszentrale eine Katjes-Werbeanzeige für irreführend. In der Anzeige in einer Fachzeitung der Lebensmittelbranche schrieb der Süßwarenhersteller: "Seit 2021 produziert Katjes alle Produkte klimaneutral." Auf der abgebildeten Fruchtgummi-Packung war das Logo "klimaneutral" abgebildet. Das Oberlandesgericht Düsseldorf gab Katjes Recht und erlaubte die Werbung, nun prüft der BGH diese Entscheidung. Ein Urteil fällt am Donnerstag voraussichtlich noch nicht.
