Bundesgerichtshof verhandelt über nicht ganz gefüllte Tube Waschgel
Um eine nicht ganz gefüllte Tube Waschgel geht es am Donnerstag (09.00 Uhr) vor dem Bundesgerichtshof (BGH) in Karlsruhe. Dieser verhandelt über die Klage der Verbraucherzentrale Baden-Württemberg gegen L'Oréal Deutschland. Die Verbraucherschützer bemängeln eine Internetwerbung der Firma. (Az. I ZR 43/23)
Auf der Website war die auf dem Kopf stehende Tube abgebildet, die im unteren Bereich transparent war und den Blick auf den orangefarbenen Inhalt freigab. Der obere Teil bis zum Falz der Tube war silbern und nicht durchsichtig. Gefüllt war sie nur bis zu diesem Bereich. Die Verbraucherzentrale sieht darin eine "Mogelpackung". Vor dem Landgericht und in der Berufung dem Oberlandesgericht Düsseldorf hatte die Klage keinen Erfolg, das Oberlandesgericht sah keine Täuschung. Nun soll der BGH entscheiden.
