Innenministerium prüft Verfassungskonformität von Gasumlage
Das Bundesinnenministerium prüft derzeit die Verfassungskonformität der geplanten Gasumlage. "Ich kann Ihnen sagen, dass diese Prüfung läuft", sagte ein Sprecher des Ministeriums am Freitag in Berlin. Das Haus von Innenministerin Nancy Faeser (SPD) teile sich diese Aufgabe mit dem Bundesjustizministerium.
Bundeswirtschaftsminister Robert Habeck (Grüne) hatte infolge der Verstaatlichung des Uniper-Konzerns rechtliche Bedenken an der Gasumlage geäußert. Mit Uniper wäre bald ein Staatsunternehmen der größte Empfänger der Gelder aus der Umlage, die zunächst die Gasversorger und nach Weiterreichung dann die Endverbraucher zahlen sollen.
Habeck hatte zunächst auf eine noch zu erledigende Prüfung der Verfassungskonformität durch das Bundesfinanzministerium verwiesen. Finanzminister Christian Lindern (FDP) widersprach jedoch: Die Prüfung der Gasumlage sei bereits geschehen und die Verstaatlichung von Uniper ändere am Ergebnis nichts.
Laut einem Bericht des "Spiegel" stützt sich Lindner auf ein Gutachten aus seinem Ministerium, in dem es vage heißt: Es "scheint vertretbar, die Auffassung aufrecht zu erhalten", dass die Gasumlage auch nach einer Verstaatlichung von Uniper haltbar bleibt. Habeck hingegen verweist laut Bericht auf interne und externe Gutachten seines Hauses, die große rechtliche Risiken sähen.
