Rechtsstreit um mutmaßlich gefälschten Impfpass in Düsseldorf endet mit Vergleich
Ein Rechtsstreit zwischen einem Arbeitgeber und einem Mitarbeiter in Nordrhein-Westfalen wegen eines mutmaßlich gefälschten Impfnachweises hat mit einem Vergleich geendet. Zwar sei die Vorlage eines gefälschten Impfpasses ein wichtiger Grund für eine fristlose Kündigung, erklärte das Landesarbeitsgericht in Düsseldorf am Dienstag. Doch habe die Firma nicht bewiesen, dass es sich tatsächlich um eine Fälschung handle.
Am Arbeitsplatz galt seit dem Spätherbst 2021 die 3-G-Regelung. Der Arbeitnehmer legte ein Impfzertifikat vor, das zwei Coronaschutzimpfungen auswies. Geimpft worden war er demnach in Berlin - jeweils an Tagen, an denen er arbeitsunfähig krank war. Dem Mann wurde fristlos gekündigt.
Bei der Ärztin fanden zu der Zeit mehrere Razzien statt. Grund seien die vielen Impfungen in der Praxis gewesen, sagte sie laut Mitteilung vor Gericht aus. Die Polizei habe aber nichts gefunden, sondern nur tatsächliche Impfungen gesehen. Auch den Kläger habe sie geimpft. Sein Neffe sei ihr Patient und habe den Mann von der Impfung überzeugt.
Das Gericht vernahm außerdem eine Polizistin, die bekundete, dass die Impfchargen grundsätzlich existierten. Allerdings sei in Nordrhein-Westfalen nicht weiter ermittelt worden. Arbeitgeber und Arbeitnehmer verständigten sich schließlich darauf, das Arbeitsverhältnis ordentlich zu beenden. Die Firma zahle dem Mitarbeiter außerdem eine Abfindung von 140.000 Euro, erklärte das Gericht.
