Kostenlose Abgabe von nicht verschreibungspflichtigem Gel an Apotheken zulässig
Geben Außendienstmitarbeiter eines Arzneimittelherstellers Apotheken Gratismuster eines nicht verschreibungspflichtigen Schmerzgels für Demonstrationszwecke, verstößt das weder gegen das Arzneimittelgesetz noch gegen das Heilmittelwerbegesetz. Es handle sich um eine Zugabe von geringem Wert, die Apotheker nicht unsachlich beeinflusse, erklärte das Oberlandesgericht (OLG) Frankfurt am Main am Mittwoch. (Az. 6 U 161/15).
Beide Streitparteien vertreiben apothekenpflichtige Arzneimittel. Zum Sortiment der Beklagten gehört ein nicht verschreibungspflichtiges Schmerzgel. Je eine Packung davon gaben Außendiensmitarbeiter der Beklagten kostenlos an Apotheken weiter. Die Packungen waren mit dem der Aufschrift "Zu Demonstrationszwecken" gekennzeichnet.
Die Frankfurter Richter lehnten einen Anspruch auf Unterlassen ab. In diesem Fall sei von einem geringen Wert der Produkte auszugehen, weil jede Apotheke nur ein kostenloses Exemplar erhalten habe. Die überwiegend geöffnet übergebenen Packungen seien durch den Aufdruck "Zu Demonstrationszwecken" weniger als einen Euro wert gewesen.
Die Gratisprobe diente erkennbar der Erprobung durch den Apotheker beziehungsweise seiner Mitarbeiter. Das Interesse, nur einem einzigen Kunden ein Probeexemplar zu überlassen, sei gewöhnlich sehr gering. Der Europäische Gerichtshof hatte in diesem Fall im Juni 2020 entschieden, dass die Richtlinien der Abgabe von Gratismustern nicht entgegenstehen.
