Einsatz von Schlagstock bei Räumung von Dannenröder Forst in Hessen rechtens
Die Nutzung eines Schlagstocks bei der Räumung des Dannenröder Forsts in Mittelhessen für den umstrittenen Ausbau der Autobahn 49 im Jahr 2020 ist rechtens gewesen. Eine geplante friedliche Besetzung einer Forstmaschine sei für den Polizisten nicht ersichtlich gewesen, teilte das Verwaltungsgericht Gießen am Montag mit. Es wies die Klage eines Aktivisten gegen das Land ab. (Az.: 4 K 4501/20.GI)
Der Kläger war bei der Räumung in einer Gruppe von acht bis zehn vermummten Menschen auf eine von Polizisten gesicherte Forstmaschine zugestürmt. Es kam zum Einsatz eines Schlagstocks, der Kläger wurde dabei verletzt.
Beide Seiten stritten vor Gericht darüber, ob der Schlagstock in Höhe des linken Oberarms oder gegen den Kopf geschlagen worden war. Der Aktivist habe ausgesagt, dass die Gruppe die Maschine friedlich habe besetzen wollen.
Dieser Ansicht folgte das Gericht nicht. Durch das Zustürmen auf die Maschine hätten Körperverletzungen des Maschinenführers, der Polizisten und Sachbeschädigungen gedroht, entschieden die Richter.
Der Aktivist sei mehrfach gewarnt worden. Nur weil er die Androhung des Einsatzes des Schlagstocks nicht mitbekommen habe, heiße das nicht, dass es die Warnungen nie gegeben habe.
Der Polizist habe in Richtung Oberarm geschlagen. Einen gezielten Schlag in Richtung Kopf habe selbst der Kläger nicht angeführt. Die Berufung ist beim hessischen Verwaltungsgerichtshof in Kassel möglich.
