Bundessozialgericht prüft Unfallschutz für Schüler bei sogenanntem Bahnsurfen
Das Bundessozialgericht in Kassel verhandelt am Donnerstag (13.00 Uhr) über den gesetzlichen Unfallschutz für einen beim sogenannten Bahnsurfen verunglückten Schüler. Der damals knapp 16-jährige Gymnasiast war nach der Schule mit dem Zug auf dem Heimweg. Mit einem mitgebrachten Vierkantschlüssel öffnete er während der Fahrt die verschlossene Durchgangstür des letzten Waggons und kletterte auf die schiebende Lok dahinter. Auf deren Dach erlitt er einen Stromschlag und stürzte brennend vom Zug. (Az: B 2 U 3/21 R)
Anders als das Sozialgericht Potsdam verneinte das Landessozialgericht Berlin-Brandenburg den Anspruch auf Leistungen aus der Schülerunfallversicherung. Der Schüler sei reif genug gewesen, um die Gefährlichkeit seines Handelns zu erkennen. Auch habe kein gruppendynamischer Druck für dieses Handeln bestanden.
