Europäischer Gerichtshof verkündet Urteil zu Datenschutz bei Onlineunterricht
Der Europäische Gerichtshof (EuGH) in Luxemburg verkündet am Donnerstag (09.30 Uhr) ein Urteil zum Datenschutz beim Onlineunterricht. Der Personalrat einer Schule im Raum Frankfurt am Main meint, das Land Hessen hätte neben einer Einwilligung der Eltern auch die der Lehrerinnen und Lehrer einholen müssen. Das vom Personalrat angerufene Verwaltungsgericht Frankfurt legte den Streit dem EuGH vor. (Az: C-34/21)
Im September vertrat ein richterlicher Rechtsgutachter, ein sogenannter Generalanwalt des EuGH die Auffassung, dass die Regelungen Hessens zum Onlineunterricht keine konkreten Datenschutzregelungen enthielten. Daher würden sie den Vorgaben der Datenschutzgrundverordnung nicht gerecht. Der EuGH ist bei seinem Urteil daran nicht gebunden, er folgt den sogenannten Schlussanträgen der Generalanwälte aber in den meisten Fällen.
