Dass Richter noch zu kommunistischen Zeiten ernannt wurden, reicht nicht aus, um ihre Unabhängigkeit in Frage zu stellen. Polen sei der EU beigetreten, ohne dass dieser Umstand Schwierigkeiten bereitet hätte, erklärte der Europäische Gerichtshof (EuGH) am Dienstag in Luxemburg. Das Oberste Gericht in Warschau wollte vom EuGH wissen, ob es vor 2018 ernannte Richter überprüfen dürfe und ob diese unabhängig und unparteiisch seien. (Az. C-132/20)
Es muss in einem Rechtsstreit über Verbraucherverträge einer Bank entscheiden. Einer der Richter, die das Urteil der Vorinstanz sprachen, kam noch zu kommunistischer Zeit ins Amt. Andere wurden nach einem Beschluss des Landesjustizrats vor zehn Jahren ernannt, 2017 wurde dessen damalige Zusammensetzung als verfassungswidrig eingestuft.
Dazu erklärte der EUGH, dass das polnische Verfassungsgericht sich 2017 nicht zur Unabhängigkeit des Justizrats geäußert habe. Die Verfassungswidrigkeit als solche reiche nicht aus, um die Ernennung der betroffenen Richter in Frage zu stellen.
Der EuGH wies auch das Argument des polnischen Bürgerbeauftragten zurück, der wiederum die Unabhängigkeit desjenigen Richters in Frage stellte, der sich an den EuGH gewandt hatte. Das Oberste Gericht dürfe dem EuGH Fragen vorlegen, hieß es.
