Verwaltungsgericht billigt Verlegung zweier Mahnwachen aus Lützerath
Das Aachener Verwaltungsgericht hat eine von der Polizei angeordnete Verlegung zweier Mahnwachen aus Lützerath vorläufig gebilligt. Die Maßnahme sei voraussichtlich rechtmäßig und nicht zu beanstanden, teilte das Gericht am Donnerstag mit. Sie sei auch verhältnismäßig, weil an den zugewiesenen neuen Standorten in Sichtweite der Siedlung "der Bezug zu dem Thema der Mahnwache weitgehend gewahrt bleibt". Gegen den Beschluss ist allerdings noch Beschwerde möglich.
Laut Gericht handelt es sich bei Lützerath nicht um einen dem allgemeinen Publikum für "kommunikativen Verkehr" zugänglichen Bereich, in dem eine Mahnwache unter Umständen auch ohne Zustimmung des Flächeneigners gestattet wäre. Lützerath gehört dem RWE-Konzern und gilt als Betriebsgelände. Das Gericht verwies außerdem auch auf eine vom Landkreis Heinsberg erlassenen Verfügung, die das Betreten des Bereichs seit Dienstag generell untersagt.
RWE will die unter dem Ort liegenden Braunkohle abbauen, dagegen wehren sich unterschiedliche Gruppierungen und Organisationen. Am Mittwoch begann die Polizei mit der Räumung des verlassenen Dorfs nahe an der Abbruchkante des Tagebaugebiets Garzweiler, in dem sich Aktivisten verschanzen.
