Bundesgerichtshof urteilt über Eintreibung von ungarischer Maut in Deutschland
Der Bundesgerichtshof (BGH) in Karlsruhe entscheidet am Mittwoch (09.00 Uhr) über die Eintreibung ungarischer Maut in Deutschland. Es geht um den Autovermieter Hertz: Mit mehreren seiner Wagen war in Ungarn ohne Vignette gefahren worden. Für die deswegen nachträglich erhobene erhöhte Mautgebühr soll nach ungarischem Recht der Halter - hier Hertz - aufkommen. (Az. XII ZR 7/22)
Das Landgericht in Frankfurt am Main verurteilte den Autovermieter dazu, knapp 960 Euro plus Inkassokosten zu zahlen. Das will Hertz aber nicht. In der ungarischen Regelung sieht die Firma einen Verstoß gegen die öffentliche Ordnung in Deutschland - sie stehe also im Widerspruch zu grundlegenden deutschen Vorschriften. Außerdem soll Hertz laut Landgericht die Summe in Euro zahlen, normalerweise müssen Schulden in fremder Währung aber auch in dieser gezahlt werden. Der BGH entscheidet nun, ob das Frankfurter Urteil Bestand hat.
