EuGH befasst sich mit Teilzeitarbeit von Lufthansa-Piloten
Der Europäische Gerichtshof (EuGH) in Luxemburg befasst sich am Donnerstag (09.30 Uhr) mit der Bezahlung von Teilzeitkräften bei der Lufthansa. Ein Pilot, der bei einer Lufthansa-Tochter in Teilzeit arbeitet, klagte vor deutschen Gerichten. Bei der Airline erhalten Mitarbeiter eine Extrazahlung, wenn eine bestimmte Zahl von Arbeitsstunden überschritten ist - diese Grenze ist für Voll- und Teilzeitkräfte gleich. (Az. C-660/20)
Der Pilot fordert, dass die Grenze für Teilzeitkräfte entsprechend gesenkt werden sollte. Sein Arbeitgeber argumentiert, dass die sogenannte Mehrflugdienststundenvergütung dazu diene, eine besondere Arbeitsbelastung auszugleichen. Das Bundesarbeitsgericht setzte das Verfahren aus und stellte dem EuGH Fragen zur Auslegung des europäischen Rechts. Nun legt der zuständige Generalanwalt sein juristisches Gutachten vor.
