Stadt muss Kita-Kosten für Pflegekind übernehmen
Die Kosten für die Förderung eines Pflegekinds in einer Kita müssen den Pflegeeltern erstattet werden. Sie würden nicht von der Unterhaltspauschale abgedeckt, entschied das Bundesverwaltungsgericht in Leipzig am Donnerstag. Es ging um ein Kind aus Nordrhein-Westfalen. (Az. 5 C 4.21)
Vormund ist nach einem früheren Gerichtsbeschluss das Jugendamt in Essen, da der Mutter die Sorge entzogen wurde. Die Stadt Aachen, wo die leibliche Mutter ursprünglich lebte, ist Jugendhilfeträger und bewilligte dem Jugendamt über die Diakonie Hilfe zur Erziehung des Kindes. Es wurde bei Pflegeeltern in einer sonderpädagogischen Pflegestelle für Kinder mit chronischen Erkrankungen und Behinderungen untergebracht. Dafür trug die Stadt die Kosten.
Die Pflegeeltern bezahlten die Beiträge für die Kita in Höhe von 44 Euro monatlich. Die Diakonie beantragte die Übernahme auch dieser Kosten durch die Stadt, was diese aber ablehnte. Das Jugendamt als Amtsvormund zog vor Gericht. Das Bundesverwaltungsgericht gab ihm nun Recht: Wenn Kita-Kosten bei der Festsetzung der Pauschale nicht berücksichtigt würden, müssten sie übernommen werden.
