BAG prüft verweigerte Lohnfortzahlung bei Coronainfektion eines Impfverweigerers
Das Bundesarbeitsgericht (BAG) in Erfurt prüft am Mittwoch (9.00 Uhr), inwieweit Arbeitgeber Impfverweigerern bei einer Corona-Infektion die Lohnfortzahlung verweigern konnten. Der Kläger ist Produktionsmitarbeiter bei einem kunststoffverarbeitenden Unternehmen in Westfalen. Er hatte sich keiner Corona-Schutzimpfung unterzogen und wurde am 26. Dezember 2021 positiv auf das Virus getestet. (Az.: 5 AZR 234/23)
Der Arbeitnehmer war daraufhin fünf Tage krankgeschrieben, danach musste er bis zum 12. Januar in Quarantäne bleiben. Der Arzt hielt eine weitere Krankschreibung nicht für erforderlich. Der Arbeitgeber zahlte für die Krankschreibungszeit Lohnfortzahlung, für die anschließende Quarantäne aber nicht mehr. Wegen seiner Impfverweigerung treffe den Kläger hier ein eigenes Verschulden, argumentierte er. Die Vorinstanzen haben den Streit unterschiedlich entschieden.
