Volkswagen muss italienische Abgas-Geldbuße wohl nicht bezahlen
Volkswagen muss eine wegen des Dieselabgasskandals in Italien verhängte Geldbuße voraussichtlich nicht bezahlen. Nach einem am Donnerstag beim Europäischen Gerichtshof (EuGH) in Luxemburg vorgelegten Rechtsgutachten steht dem das Verbot der Doppelbestrafung entgegen, weil VW bereits in Deutschland ein Bußgeld in Höhe von einer Milliarde Euro bezahlt hat. Volkswagen hat weltweit 10,7 Millionen Dieselfahrzeuge mit abgasmanipuliertem Motor verkauft, 700.000 davon in Italien. Die italienische Wettbewerbs- und Marktaufsichtsbehörde hatte daher 2016 gegen Volkswagen eine Geldbuße in Höhe von fünf Millionen Euro verhängt.
VW habe die Schadstoffmessungen manipuliert, um so die Typengenehmigung für diese Fahrzeuge zu erhalten. Zudem habe VW in seiner Werbung trotz der Manipulationen behauptet, dass die Autos den umweltrechtlichen Vorschriften entsprechen. Beides verstoße gegen das italienische Verbrauchergesetzbuch, lautete die Argumentation.
VW sieht darin eine unzulässige Doppelbestrafung. Denn die Staatsanwaltschaft Braunschweig habe 2018 wegen der Abgasmanipulationen ein Bußgeld in Höhe von einer Milliarde Euro verhängt. Dies sei bereits rechtskräftig und bezahlt. Dabei habe sich dieses Bußgeld auf das weltweite Inverkehrbringen der abgasmanipulierten Autos bezogen – und damit auch auf Italien.
Das oberste Verwaltungsgericht Italiens, der Staatsrat in Rom, legte den Streit dem EuGH vor. Dort folgte nun ein richterlicher Rechtsgutachter, Generalanwalt Manuel Campos Sánchez-Bordona, den Argumenten von Volkswagen.
Das Braunschweiger Bußgeld und auch die Wettbewerbsbuße in Italien seien letztlich beide "strafrechtlicher Natur". Daher greife hier der Grundsatz, dass niemand wegen derselben Tat zweimal bestraft werden darf. Da hier das deutsche Bußgeld bereits rechtskräftig und bezahlt sei, stehe es dem Bußgeld Italiens entgegen.
Das abschließende Urteil wird in einigen Monaten erwartet. Dabei ist der EuGH nicht an diese Einschätzung gebunden, er folgt den Generalanwälten aber in den meisten Fällen.
