EuGH: Bei Nachweis muss Suchmaschine Links zu falschen Artikeln auslisten
Eine Suchmaschine darf die Links zu Artikeln nicht mehr anzeigen, wenn Betroffene nachweisen, dass die Berichte offensichtlich falsch sind. In einem solchen Fall überwiegen der Schutz von Daten und Privatsphäre, entschied der Europäische Gerichtshof (EuGH) in Luxemburg am Donnerstag. Der deutsche Bundesgerichtshof in Karlsruhe hatte um Auslegung des EU-Rechts gebeten - er muss über eine entsprechende Klage entscheiden. (Az. C-460/20)
Diese wurde von zwei Geschäftsführern einer Gruppe von Investmentgesellschaften gegen Google eingereicht. Sie geben an, dass kritische Artikel über die Firmen auf einer US-Website falsch seien und fordern, dass die Artikel bei der Suche nach ihrem Namen nicht mehr auftauchen.
Im konkreten Fall muss nun der Bundesgerichtshof entscheiden. Er ist dabei an die Rechtsauslegung des EuGH gebunden. Ein Termin für die Entscheidung in Karlsruhe wurde noch nicht veröffentlicht.
