Naturschützer scheitern mit Klage gegen Kiesabbau an hessischem Waldsee
Der hessische Landesverband des Bunds für Umwelt und Naturschutz (BUND) ist mit einer Klage gegen den Abbau von Kies in einem sogenannten Bannwald vor dem Bundesverwaltungsgericht gescheitert. Die Revision sei zurückgewiesen worden, sagte eine Gerichtssprecherin am Donnerstag in Leipzig. Es ging um den den Langener Waldsee zwischen Frankfurt am Main und Darmstadt. (Az. BVerwG 7 C 4.21 u.a.)
Dort hatte das Regierungspräsidium Darmstadt vor neun Jahren den Abbau von Kies und Quarzsand auf mehr als 60 Hektar von besonders schützenswertem Wald genehmigt. Dagegen klagte der BUND aus Sorge um den Artenschutz vor dem Verwaltungsgericht Darmstadt, hatte aber keinen Erfolg. Nach der Berufung am hessischen Verwaltungsgerichtshof in Kassel scheiterte nun auch die Revision vor dem Bundesverwaltungsgericht.
