Bundesgerichtshof verhandelt über Maklergebühr für Reservierung von Grundstück
Der Bundesgerichtshof (BGH) verhandelt am Donnerstag (10.00 Uhr) über die Maklergebühr für die Reservierung eines Grundstücks. Ein Maklerbüro aus Sachsen vermittelte das Grundstück, das mit einem Einfamilienhaus bebaut war. Die Kläger wollten es kaufen und unterzeichneten eine Reservierungsvereinbarung. (Az. I ZR 113/21)
Darin verpflichtete sich der Makler gegen eine Gebühr in Höhe von 14,37 Prozent der Provision, das Grundstück bis zu einem bestimmten Datum für die Interessenten zu reservieren. Später entschieden sich die Kläger, doch nicht zu kaufen. Sie wollten die Reservierungsgebühr zurück und verklagten das Maklerbüro in Dresden, wo Amts- und Landgericht die Klage aber abwiesen. Deswegen zogen die Kläger vor den BGH.
