Verfassungsbeschwerde in Streit über angeblich falsche Kundenrezensionen scheitert
Ein Händler von Balkonkraftwerken ist im Rechtsstreit mit einem Wettbewerber mit einer Beschwerde vor dem Bundesverfassungsgericht gescheitert. Die Beschwerde richtete sich gegen eine Eilentscheidung des Landgerichts Düsseldorf, wie das Verfassungsgericht in Karlsruhe am Montag mitteilte. Der Wettbewerber hatte moniert, dass der Händler auf einem Online-Bewertungsportal Kundenrezensionen künstlich generiere. (Az. 1 BvR 1728/23)
Er mahnte den Händler ab. Dieser teilte mit, dass er sich erst nach dem Urlaub seiner Geschäftsführer - und damit nach der gesetzten Frist - äußern könne. Daraufhin erließ das Düsseldorfer Gericht auf Antrag des Wettbewerbers eine einstweilige Verfügung, ohne den Händler anzuhören.
Dagegen zog dieser vor das Bundesverfassungsgericht. Der Rechtsweg sei hier aber nicht erschöpft, erklärten die Karlsruher Richter nun. Damit sind vorrangig die Fachgerichte zuständig. Das Verfassungsgericht nahm die Beschwerde nicht zur Entscheidung an.
