Kein Recht auf Laufen über Nachbargrundstück bei unbequemem Weg über eigenem Boden
Dass der Weg von der Straße zum eigenen Grundstück unbequem ist, begründet kein Recht darauf, über das Grundstück der Nachbarn zu laufen. Ein sogenanntes Notwegerecht bestehe nur dann, wenn das Grundstück von der Straße aus gar nicht anders zu erreichen sei, erklärte das Landgericht im rheinland-pfälzischen Frankenthal am Montag. Es wies die Klage eines Ehepaars gegen das Aufstellen eines Zauns auf dem Nachbargrundstück ab.
Das Ehepaar aus Rheinland-Pfalz war eine Zeitlang mit Mülltonnen, Fahrrädern oder Motorrädern über das Nachbargrundstück zum eigenen Grundstück gelaufen. Als die Nachbarn einen Zaun errichteten, war dies nicht mehr möglich - das Ehepaar musste seine Sachen über zwei Stufen und durch den Hausflur in den Innenhof bringen. Das fanden sie nicht zumutbar, zumal der Mann eine Gehbehinderung hat.
Mit ihrer Klage hatten sie aber keinen Erfolg, weil ihr Grundstück an der Ecke liegt und an öffentliche Straßen grenzt. Es spiele keine Rolle, dass der Weg umständlicher, unbequemer oder teurer herzurichten sei, erklärte das Gericht. Auch die Behinderung des Manns sei hier nicht maßgeblich. Das Urteil ist rechtskräftig.
